ARAZ Media — Terms of Service

Effective Date: January 1, 2026

Company: ARAZ Media (“ARAZ Media,” “we,” “us,” “our”)

Client: The person or entity purchasing services (“Client,” “you,” “your”)

By booking services, paying a deposit, signing an invoice/proposal, or accepting delivery, you agree to these Terms.

1) Services

We provide photo, video, drone, and related media services as described in your invoice, proposal, or booking confirmation (“Services”).

2) Scheduling and Access

You are responsible for providing safe access to the property/location at the scheduled time and ensuring the property is ready to be photographed/filmed. If access is not available or the property is not reasonably ready, we may reschedule and/or charge additional fees.

3) Fees and Payment

Fees are listed on the invoice/proposal. Payment terms are as stated on your invoice. We may withhold delivery until payment is received in full.

4) Cancellations and Rescheduling

Cancellation/reschedule policies and any related fees will be stated on your invoice/proposal or booking confirmation. Weather may require rescheduling for safety and quality, especially for exterior/drone work.

5) Delivery and Turnaround

Estimated turnaround times are provided at booking or on your invoice. Delivery is provided digitally (e.g., via Pixieset or similar). RAW/unedited files are not included unless stated in writing.

6) 30-Day Access and Storage

Delivery links/galleries are available for 30 days from delivery unless stated otherwise. You are responsible for downloading and storing your files. We are not responsible for file storage, retention, or re-delivery after the 30-day access window.

7) Copyright and License

All media is copyrighted by ARAZ Media. After full payment, you receive a non-exclusive, non-transferable license to use the delivered media for marketing the specific property/project described in the booking (including MLS, listing platforms, social media, and your website).

You may not sell, transfer, or sublicense the media to third parties without our written permission.

8) Client Requests for Alterations / Virtual Staging

If you request virtual staging or significant digital alterations, you are responsible for any required disclosures and compliance with MLS rules and applicable laws.

9) Drone Services

Drone services are subject to weather, airspace restrictions, permissions, and safety. If drone flight is not possible, we may substitute a comparable service, reschedule, or adjust deliverables.

10) Limitation of Liability

To the maximum extent permitted by law, ARAZ Media is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our total liability for any claim is limited to the amount you paid for the Services for the specific project giving rise to the claim.

11) Portfolio Use (Default On)

Unless you request in writing before the shoot, you allow us to use delivered media for our portfolio, website, social media, and marketing.

12) Governing Law and Venue

These Terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Nassau County, New York, and the parties consent to that venue.
